Mark Jaeger provides: This individual is wearing either majors’ or lieutenant colonels' "oak leaves." The fact that these appear to be "subdued" rank insignia indicates a photo date of 1863-1865. As I recall, the Army of the Cumberland formally allowed them to be worn beginning in Fall 1863.
